NOTICE OF CLASS ACTION SETTLEMENT

You may have received a notice regarding this settlement because records indicate that Inflection Risk Solutions, LLC (“Defendant” or “Inflection”) furnished a background check report about you that (1) identified a Minnesota offense as a felony when it had been deemed a misdemeanor under Minn Stat. § 609.13 and/or (2) included an offense that was labeled as “offense class: violence” and the description of the charge does not involve a violent act, or threatened violent act, against another person. Your legal rights will be affected by the settlement of this lawsuit. Please read this notice carefully. It explains the lawsuit, the settlement, and your legal rights, including the process for receiving a settlement payment, excluding yourself from the settlement, or objecting to the settlement.

This is a Court authorized notice of a proposed settlement in a class action lawsuit.

  • There are two proposed Settlement Classes, which are defined in detail within this Notice.  Membership in the Settlement Classes will be determined based upon Defendant’s records.  You may be eligible to receive benefits from this class action settlement.  
  • For Deemed Misdemeanor Class Members, the parties estimate you will receive a monetary payment between $470-$480 if you do not opt out.  You do not need to submit a claim form to receive a payment for being a member of the Deemed Misdemeanor Class. 
  • For Nationwide Inaccurate Offense Characterization Class Members, the parties estimate you will receive between $70-$95 if you do not opt out.  Some Nationwide Inaccurate Offense Characterization Class Members have to submit a claim form to receive a payment.  The postcard or email notice you received should have indicated whether you need to submit a claim form.  
  • If you are a member of both Classes, you will receive both payments, provided you make a claim if so required for the Nationwide Inaccurate Offense Characterization Class.  
  • Your individual mailed or emailed notice indicates which Class you are in. If you have questions about whether you are in the Class, which Class you are in, or whether you need to submit a claim form, please contact Class Counsel at  Info@BackgroundReportSettlement.com or 855-528-0050
  • The final amount of monetary payments you will receive depends on the Class or Classes you are in, the number of claims filed, and other factors, as further described in the Settlement Agreement.
  • The Court still has to decide whether to approve this settlement, which may take some time.

 

DO NOT ADDRESS ANY QUESTIONS ABOUT THE SETTLEMENT TO THE COURT OR THE CLERK’S OFFICE. THEY ARE NOT PERMITTED TO ANSWER YOUR QUESTIONS.

YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT:
Do Nothing If you are a class member, you should have received a postcard notice in the mail and/or an email notice. Your notice indicates whether you are a member of the Deemed Misdemeanor Class, the Nationwide Inaccurate Offense Characterization Class, or both Classes. If you are a Nationwide Inccurate Offense Characterization Class Member, you may be required to submit a Claim Form to receive a payment. Claim Forms must be postmarked or submitted online no later than October 28, 2022. Your email or postcard notice indicates whether you are required to return a Claim Form to receive a payment for being a member of the Nationwide Inaccurate Offense Characterization Class.
Exclude Yourself You can remove yourself from participation in this class action. If you exclude yourself, you will not receive a benefit from this settlement, but you will retain any rights to file a separate lawsuit or legal action against Inflection.
Object You can remain a Settlement Class Member, but write to the Court and explain why you don’t think the settlement is fair, reasonable, or adequate. This is called an objection. You must file your objection by October 28, 2022.
Go to a Hearing If you submit a timely objection to the settlement, you may also ask the Court for permission to speak at the final approval hearing. To do so, you must include a notice of intention to appear at the hearing when you submit your objection.
